A visa under the right of free movement can be applied for in order to join European Union citizens and nationals of the EEA (Iceland, Norway, Liechtenstein).

Who can apply?

Family members entitled to freedom of movement are:

• Spouses
• Relatives of the Union citizen or their spouses or life partners in the direct line of descent who are under 21 years of age or who are granted maintenance (children or grandchildren)
• Relatives of the Union citizen or their spouses or partners in the direct ascending line who are granted maintenance (parents, grandparents)

Close relatives may also qualify but face stricter requirements.

Third-country nationals who are family members of an EU/EEA citizen generally require a visa to enter Germany.

Process of the application

In the visa application procedure for third‑country national family members of Union citizens, there are certain facilitations in the process.

Book an appointment on our booking system then contact us via email (info@lago.diplo.de), stating your registration number. You will then be given an appointment withhin a few weeks.

Also the processing time normally is shorter.

Be aware:

It can be determined that a person has no right to the benefit if it is proven that they pretended to meet the required conditions by using fake or falsified documents, or by providing false information. Therefore, the Consulate General has the right to undertake a verification of your documents and, if necessary, request further documentation.

For a family member who is not an EU citizen, it can also be determined that they have no right to the benefit if it is proven that they are not actually joining or accompanying the EU citizen to live together as a family. Therefore, the Consul General has the right to request further documentation and conduct a interview to verify the marriage.

What documents do I need?

Instruction:

The following documents have to be submitted as indicated below:
• Sort your application according to this list.
• The required documents must be submitted in full at the personal interview. Documents sent in advance cannot be considered.
• Do not staple any of the documents.
• Copies need to be in DIN A4 format and black/white. Copies in color will not be accepted.
Incomplete and unsorted applications will not be accepted.

a. Passport of Person living in Germany

  • copy of data page

b. German registration certificate (Meldebescheinigung)

  • not older than 6 months

c. Entry and exit stampes

  • from all visits to Nigeria of the Person living in Germany

d. if applicable: divorce decrees of earlier marriages

Divorce decrees of all previous marriages of the applicant and person living in Germany.

The divorce must have already been legally binding before the new marriage was entered into.

Nigerian divorce decrees:

  • only divorce decrees issued by the locally competent court are accepted

German divorce decree:

  • with “Rechtskraftnachweise”

from the EU/EEA citizen living in Germany, confirming their intention to take up joint residence with you and declaring that they will cover your living expenses.

  • If employed: Employment contract, recent payslips, or equivalent proof.
  • If not employed: Proof of sufficient financial means to cover living expenses and health insurance.

  • original passport + copy of data page
  • issued in the last 10 years
  • valid for at least 6 more months
  • at least two free pages

  • as proof of a legal residence status in Nigeria
  • only for applicants with a nationality other than Nigerian

For births before December 15, 1992

1. Certified copy of the local birth register extract based on the first registration


and

2. Affidavit* (“Declaration of Age”) of one parent or the head of the family** if both parents are deceased


and

3. Copy of an identity document showing the signature of the person making the affidavit

For births at or after December 15, 1992

1. NPC birth certificate, issued from the NPC of your place of birth


if you do not have a birth certificate from the NPC:

1. Certified copy of the local birth register extract based on the first registration


and

2. Affidavit* (“Declaration of Age”) of one parent or the head of the family**


and

3. Copy of an identity document showing the signature of the person making the affidavit

* If necessary with a note of illiteracy, preferable e-Affidavit

** Head of family and at least 10 years older than the applicant

For example, if you changed your name or there was a mistake on any of your documents
e.g.
- Affidavit of Change of Names (with the published newspaper advertisment)
- Affidavit of Reconciliation of Names
- Affidavit of Spinster- / Bachelorhood
- Affidavit of Facts


• if necessary, with a note of illiteracy
• issued by the competent court


Additionally, a copy of an identification document must be submitted showing the signature of the person making the affidavit

  • hospital birth registration
  • weighing card
  • baptism certificate
  • voter ID card
  • vaccination certificate
  • other expired passports

  1. Primary

  • marriage certificate

  • proof of descent from the EU/EEA citizen or his/her spouse

  • if you are 21 years or older you also need to provide proof of maintenance

2. proof of maintenance

1. Detailed proof of your relationship to the EU/EEA citizen

2. Depending on your category, additional documents may be required:

  • Relatives in the collateral line (e.g. siblings, uncles and aunts, cousins, etc.)

    roof that the EU citizen has provided you maintenance for at least two years (not temporarily), or

    Proof that the EU citizen lived with you in the same household for at least two years before moving to Germany, or

    Evidence of a personal care relationship due to serious health reasons.

  • Child under 18 in the guardianship or foster care of the EU citizen:

    Proof that you are dependent on them.

  • Partner in a long-term relationship with the EU citizen:

    Proof that you and your partner will live together in Germany on a non-temporary basis.

In all cases, you must also prove that your livelihood in Germany is secured for the right of residence to be granted.

  • all originals for the copies mentioned above must be submitted in chronological order.

Your original documents will be returned to you once your application has been processed.

  • not older than 6 months

  • size: 3,5x4,5 cm
  • not glued or stapled to the application form

For students / vocational training / voluntary service

The declaration must allow the minor to travel to Germany to study / work and to withdraw money from the blocked account set up in Germany.
